Preamble

The general conditions of sale apply to all customers and visitors of the site https://www.maxinuts.com. Maxi Nuts reserves the right to modify and update the general conditions of sale without notice, it is the responsibility of the customer to read the general conditions of sale.

Products

The products offered for sale are presented on the Maxi Nuts website. Presentation elements such as photographs and texts are not contractual. Maxi Nuts retains the ability to delete, modify and/or add products presented on the site.

Customer's obligations

The customer undertakes to give real information necessary for the sale as requested online such as, his name, surname, address, telephone and e-mail valid. The customer is responsible for consequences arising from false or inaccurate information transmitted.

Once the order is placed, Maxi Nuts sends the customer an e-mail confirming it. In a second step, it informs him of the sending of the products. In addition, the customer is held responsible for damage resulting from misuse or improper storage of the product (s) purchased (s).

Order

All orders are validated only after acceptance of the payment. Maxi Nuts reserves the right to cancel or refuse an order in case of dispute with the customer on a previous order or any other reasons including technical. If the products are unavailable or the order can not be processed, Maxi Nuts will inform the Customer by e-mail as soon as possible. The customer can then cancel the order and be reimbursed, if necessary, the sums already paid.

Price

The prices displayed on the site are indicated in euros. Prices displayed do not include shipping, delivery and other related costs. Shipping and delivery charges will be indicated in the customer's basket, before final confirmation of the order. Prices can be modified at any time, without notice and especially in case of change of tax or economic data.

Delivery

Maxi Nuts delivers its products in mainland France within 2-5 business days. The products are delivered to the delivery address indicated during the ordering process. The delivery address is also confirmed in the order confirmation email to the customer. In the event of a change or error in the delivery address, the customer must contact Maxi Nuts (delivery@maxinuts.fr) 24 hours before the order is shipped. Go Nuts can not be held responsible for the consequences due to a delay in delivery that is not his fault.

Payment

The full payment must be made when ordering. On the site, the customer settles his order by credit card (Visa, Mastercard, American Expressand PayPal). Payments are secure.

RIGHT TO RETRACT

In accordance with the provisions of Article L.221-18 of the Consumer Code, the customer has a withdrawal period of 14 days from the receipt of products order to exercise his right of withdrawal without having to justify reasons nor to pay penalties. Returns are to be made in their original condition and complete (packaging, accessories, notices). In this context, the responsibility of the customer is engaged. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. The return costs are the responsibility of the customer.
In case of exercise of the right of withdrawal, the company Maxi Nuts will refund the sums paid, within 14 days of notification of the customer's request and via the same means of payment as used in the order.
In accordance with the provisions of Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to:

• The supply of goods made to the consumer's specifications or clearly personalized.
• The supply of goods that may deteriorate or expire quickly.
• The supply of goods that have been unsealed by the consumer after delivery and that can not be returned for reasons of hygiene or health protection.
• The supply of perishable goods, manufactured in large quantities especially for a consumer.

GUARANTEE

In accordance with Articles L. 217-4 to L. 217-13 of the Consumer Code, the customer has a legal guarantee of conformity. Therefore, in case of non-compliance of a product sold, it can be exchanged or refunded. Maxi Nuts, given the characteristic of the products sold, does not require the customer to return non-compliant products. However, it is requested that the customer sends Maxi Nuts photos showing the lack of conformity invoked to the email address returns@maxinuts.fr. It is brought to the attention of the customer that the Maxi Nuts production workshop contains allergenic ingredients (nuts, peanuts, hazelnuts ...) and ingredients that may contain traces of gluten, lactose ...

In accordance with Articles 1641 to 1649 of the French Civil Code, the Customer also has a legal guarantee of hidden defects. Therefore, if the purchased products contain hidden defects that make them unfit for consumption, the customer may request an exchange or refund. Maxi Nuts, given the characteristic of the products sold, does not require the customer to return non-compliant products. However, it is requested that the customer sends to Maxi Nuts photos showing the defect (s) invoked (s) to the email address returns@maxinuts.fr.

Maxi Nuts may offer its customers, in case of non-compliance and / or hidden defects to offer them a credit for an amount equivalent to the price of the product (s) concerned (s) concerned that could be used by the customer for any next order realized on the site.

Disputes

In the event that a dispute arises from this contractual relationship, the parties undertake before any legal action to seek an amicable solution. Any dispute relating to the interpretation or the execution of these general conditions of sale will, in the absence of amicable agreement, brought before the competent courts French. The parties agree that these general conditions of sale are subject to the application of French law.
